These General Terms of Use govern, pursuant to Italian law, the contractual relationship between Save My Room, with registered office at Via Capitano Fiorillo, Marina di Carrara 54033, VAT number 01474170451, represented by its legal representative pro tempore (hereinafter "Save My Room" or the "Provider"), and the user who browses and uses the services offered through the website www.savemyroom.it (hereinafter the "Platform").
1. Definitions and Scope of the Contract For the purposes of this contract, the following definitions shall apply:
• Platform: the website www.savemyroom.it and related applications, managed by Save My Room, which acts as a provider of intermediary services.
• User: any natural or legal person who accesses the Platform and uses its services. The User may be classified as a "Consumer" (a natural person acting for purposes outside of any business, commercial, artisanal, or professional activity) or a "Professional" (a natural or legal person acting in the exercise of their business).
• Service: the digital intermediation service offered by Save My Room, which allows Users to search for and book accommodations or rooms (hereinafter "Accommodations") offered by third parties (hereinafter "Accommodations") for short-term stays, with a particular focus on last-minute needs.
The purpose of this contract is the provision, by Save My Room, of a digital service that facilitates the conclusion of short-term rental or stay agreements between Users and Accommodations. Save My Room is not a party to the contract established between the User and the Accommodation and assumes no responsibility for the execution of this relationship.
2. Acceptance of the Terms and Applicable Laws. Access to and use of the Platform implies full and unconditional acceptance of these General Terms of Use. The User declares having read, understood, and accepted this agreement in its entirety. The relationship is governed, except where not expressly provided, by the provisions of the Italian Civil Code, Legislative Decree No. 70 of April 9, 2003 (e-commerce), Legislative Decree No. 206 of September 6, 2005 (Consumer Code), Regulation (EU) 2016/679 (GDPR), and Regulation (EU) 2022/2065 (Digital Services Act).
3. Platform Registration. To fully utilize the Service, the User must create a personal account, providing truthful, accurate, and up-to-date information. Registration is restricted to adults. The User is solely responsible for the safekeeping and confidentiality of their login credentials and agrees to immediately notify Save My Room of any unauthorized use of their account.
4. Service Operation and Booking Completion. The Platform allows the User to view the availability of Accommodations, consult their features, and proceed with booking. The accommodation contract is considered concluded between the User and the Accommodation Provider when the User receives the booking confirmation. Save My Room strives to provide accurate information, but the accuracy of the details relating to the Accommodations (descriptions, prices, availability) lies solely with the Accommodation Providers.
5. Fees and Payment Methods. Use of the Platform for searching for accommodations is free. The price for the stay is indicated on the booking page and must be paid by the User using the payment methods available on the Platform. Transactions are handled through secure payment service providers that comply with Directive (EU) 2015/2366 (PSD2). Save My Room does not store complete credit card details.
6. User Obligations. The User undertakes to use the Platform in accordance with the law, public order, and morality, as well as these Terms. It is prohibited to use the Platform for unlawful or fraudulent purposes or to publish content that is defamatory, offensive, or infringes the rights of third parties. The User assumes full responsibility for his or her actions and any content published.
7. Provider Limitations of Liability. Save My Room offers the Service "as is," without providing any explicit or implicit guarantee of its continuity or absence of errors. As a mere intermediary, Save My Room cannot be held liable for the non-fulfillment or improper fulfillment of the obligations arising from the accommodation contract between the User and the Accommodation Facility, nor for any damages suffered by the User during the stay.
8. Right of Withdrawal. The User is informed that, pursuant to Article 59, paragraph 1, letter n) of the Consumer Code, the right of withdrawal is excluded for contracts involving the provision of accommodation for non-residential purposes, when the contract provides for a specific date or period of performance. Therefore, once the booking has been confirmed, the User may not exercise the right of withdrawal, unless different and more favorable conditions are provided by the individual Accommodation Facility.
9. Intellectual Property All content on the Platform, such as trademarks, logos, text, graphics, and software, is the exclusive property of Save My Room or its licensors and is protected by copyright law. Any unauthorized reproduction, modification, or use of such content is prohibited.
10. Personal Data Protection The User's personal data is processed in full compliance with Regulation (EU) 2016/679 and applicable national legislation. For full details on the purposes and methods of processing, the User is invited to consult the Privacy Policy and Cookie Policy, available on the Platform.
11. Unilateral Amendments to the Agreement. Save My Room reserves the right to modify these Terms and Conditions at any time. Any such modifications will be communicated to the User at least fifteen days in advance and will become effective from the date indicated in the communication. The User will have the right to withdraw from the agreement without charge if they do not wish to accept the new terms and conditions.
12. Applicable Law and Dispute Resolution. This agreement is governed by Italian law. For any dispute arising in connection with the interpretation, execution, or validity of this agreement, if the User is a Consumer, the exclusive jurisdiction lies with the courts of the Consumer's place of residence or domicile.
Consumer Users are also informed of the possibility of using alternative dispute resolution (ADR) procedures and the European Online Dispute Resolution (ODR) platform, accessible via the European Commission website.
13. Specific Approval of Unfair Contract Clauses Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the User declares to have carefully read and specifically approve the following clauses: Article 7 (Limitations of Liability of the Provider); Article 8 (Right of Withdrawal); Article 11 (Unilateral Amendments to the Contract); Article 12 (Applicable Law and Dispute Resolution).
